Terms & Conditions
1.Scope of Application
These Terms and Conditions apply to all bookings of classes and workshops offered by Heels by Nastya (hereinafter referred to as the “Organizer”).
The offer is intended exclusively for private individuals (consumers).
2.Registration & Conclusion of Contract
Registration for classes and workshops takes place online via the website or booking system of the Organizer.
By completing a booking, a binding contract is concluded between the participant and the Organizer.
3.Participation Requirements
Participation in classes and workshops is at the participant’s own responsibility.
Participants confirm that they are physically and medically fit to take part in the booked activities.
4.Prices & Payment
All prices are stated in euros.
Payment must be made in advance using the payment methods offered in the booking system.
5.Classes – Cancellation & Credits
5.1 Cancellation by Participants
Classes may be cancelled at least 24 hours before the scheduled start time.
In this case, a credit will be issued.
Cancellations made less than 24 hours before the class start time or non-attendance will result in the booking being forfeited without replacement.
Refunds of the purchase price are excluded.
5.2 Credits
Credits:
- are non-transferable
- may only be used by the person who made the original booking
- are valid for 6 months from the date of issue
- may only be redeemed for classes (not workshops), unless explicitly stated otherwise
6.Workshops
Workshops are booked on a binding basis.
Cancellation or refund of the purchase price is not possible, even in the event of non-attendance.
7.Cancellation by the Organizer
The Organizer reserves the right to cancel classes or workshops for important reasons (e.g. illness, force majeure, unforeseen circumstances, or insufficient number of participants).
In the event of cancellation by the Organizer, participants will receive a credit.
Any further claims, in particular claims for refunds or damages, are excluded.
8.Liability
Participation in classes and workshops is at the participant’s own risk.
The Organizer shall not be liable for injuries or health-related damages unless caused by intentional or grossly negligent conduct of the Organizer.
No liability is assumed for personal belongings brought to the venue.
9.Photo and Video Recordings
9.1 Consent
By registering for or participating in classes or workshops, participants agree that photo and video recordings taken by the Organizer during classes or events, in which they may appear, may be used for advertising and marketing purposes.
Publication may take place in particular:
- on the website https://heelsbynastya.com/
- on the Organizer’s social media channels (e.g. TikTok or Instagram)
Use of the recordings is free of charge.
9.2 Publication Notice
Participants are informed that photos and videos published on the internet are accessible worldwide.
Complete control over further use by third parties cannot be guaranteed.
9.3 Withdrawal of Consent
Consent to the use of photo and video recordings may be withdrawn at any time with effect for the future.
The withdrawal must be submitted by email to [email protected], specifying the photo or video concerned as precisely as possible.
9.4 Group Recordings
In the case of group photos or group videos, the later withdrawal of consent by an individual participant will generally not result in the removal of the recording, provided that the person concerned is not the main focus of the image and no overriding legitimate interests exist.
10.Data Protection
Personal data is processed in accordance with applicable data protection laws.
The current Privacy Policy of Heels by Nastya applies and is available on the website.
11.Exclusion of the Right of Withdrawal
There is no right of withdrawal, as the services offered constitute leisure activities with a fixed date or period pursuant to Section 312g (2) No. 9 of the German Civil Code (BGB).
12.Final Provisions
Should individual provisions of these Terms and Conditions be or become invalid in whole or in part, the validity of the remaining provisions shall remain unaffected.
The laws of the Federal Republic of Germany shall apply.
